TEAL DICHARRY v. NICHOLAS MILLER
In Re: Teal Dicharry, applying for supervisory writs, 23rd Judicial District Court, Parish of Assumption, No. 110689. BEFORE: HIGGINBOTHAM, THERIOT AND CHUTZ, JJ.
WRIT GRANTED. The district court's September 9, 2016 order denying in forma pauperis status to relator, Teal Dicharry, is reversed. The district court abused its discretion in denying in forma pauperis status to relator, Teal Dicharry, based upon her poverty and lack of means. See Benjamin v. National Super Markets, Inc., 59872 (La. 10/10/77), 351 So.2d 138, writ denied, 63636 (La. 1/12/79), 366 So.2d 561. Judgment is granted in favor of relator, Teal Dicharry, granting her request for in forma pauperis status pursuant to La. Code Civ. P. art. 5181, and this matter is remanded to the district court for further proceedings.
