ORDER

The Court has the parties' June 14, 2016 agreed motion to remand in lieu of settlement. In the motion, the parties ask us to abate the case and remand to the 116th Judicial District Court for further proceedings related to settlement. The judgment appealed in this case was out of the 254th Judicial District Court. Therefore, we GRANT the motion to the extent we REMAND this case to the 254th Judicial District Court for further proceedings related to the settlement agreement of the parties.

On motion of the parties, we will abate the case pending further disposition in the trial court. When the trial court has entered judgment in accordance with the settlement agreement, the parties are directed to notify this Court and file a proper motion to dismiss the appeal. If the parties fail to notify the Court or file a proper motion to dismiss this appeal within thirty days of the date of this order, the Court will take whatever action it deems necessary, including dismissing the appeal for want of prosecution.

We ABATE this appeal for thirty days or until the parties file a motion to dismiss the appeal, whichever occurs first.
