Before the Court is the parties' June 12, 2023 joint motion to abate the appeal pending mediation or, alternatively, second motion for an extension of time to file appellant's opening brief. We GRANT the motion to the extent that we extend the deadline for appellant's brief to July 17, 2023. The Court will reconsider abatement should the parties file a motion providing the date of any scheduled mediation.
