ORDER

The Court REINSTATES the appeal.

On June 4, 1997, this appeal was abated due to the filing of bankruptcy by appellant Lyman Harris. In response to our February 22, 2016 letter inquiring about the status of the bankruptcy proceedings, counsel for Mark H. How responded that following the bankruptcy filing and abatement, the parties resolved all disputes by way of settlement agreement.

Accordingly, we ORDER appellants to file, within TEN DAYS of the date of this order, a motion to dismiss the appeal. See TEX. R. APP. P. 42.1. If a motion to dismiss is not filed within that time, the Court will, without further notice, dismiss the appeal. See TEX. R. APP. P. 42.3.
