Department of Revenue v. Robinson

District Court of Appeal of Florida, Fourth District
May 31, 1995
655 So. 2d 220 (Fla. Dist. Ct. App. 1995)

Opinion

No. 95-0809.

May 31, 1995.

Petition for review from the Circuit Court, Broward County, James M. Reasbeck, J.

William H. Branch and Joseph R. Boyd of Boyd and Branch, P.A., and Chriss Walker, Dept. of Revenue, Office of Child Support Enforcement, Tallahassee, for petitioner.

Roy L. Lucas, Fort Lauderdale, for respondent.

Petitioner seeks certiorari review of an order requiring scientific testing as to the paternity of a child. Here the paternity of the child had been conclusively established by previous rulings and was thus protected by the doctrine of res judicata. We grant the writ on the authority of Department of Revenue v. Goulbourne, 648 So.2d 856 (Fla. 4th DCA 1995), and quash the order under review.

STONE and PARIENTE, JJ., concur.
