The opinion filed April 29, 2005 is modified as follows: On page 6, in the third paragraph of Procedural Background, the sentence that reads “On June 18 and 19, 2002, a Department administrative law judge (ALJ) held hearings� is deleted. The following sentence is inserted in its place: “On June 18 and 19, 2002, an administrative law judge (ALJ) held hearings.�

The modification does not affect the judgment.
