Marcos Vincent DELEON, Appellant v. The STATE of Texas, Appellee

From the 437th Judicial District Court, Bexar County, Texas
Trial Court No. 2015CR5491
Honorable Lori I. Valenzuela, Judge Presiding

ORDER

Sitting: Sandee Marion, Chief Justice Karen Angelini, Justice Patricia Alvarez, Justice

Rule 9.10 of the Texas Rules of Appellate Procedure, entitled "Privacy Protection for Documents Filed in Criminal Cases," prohibits documents filed in this court to contain the name of any person who was a minor at the time the offense was committed. See TEX. R. APP. P. 9.10. On April 17, 2017, appellant filed a brief that identifies the minor victim in this case by name and, therefore, flagrantly violates Rule 9.10. We, therefore, STRIKE appellant's brief.

We ORDER appellant's counsel, C. Wayne Huff, to file a corrected appellant's brief that identifies the minor victim only by her initials or a fictitious name, but does not otherwise change the brief's contents. The corrected appellant's brief must be filed in this court no later than seven (7) days from the date of this order.

PER CURIAM It is so ORDERED on this August 18, 2017. ATTESTED TO:

/s/_________

Luz Estrada

Chief Deputy Clerk
