ORDER

Before Chief Justice Wright and Justices Lang-Miers and Stoddart

We GRANT appellant's February 1, 2016 motion for extension of time and for leave to file motion to review the trial court's indigence determination. The motion to review the trial court's indigence determination is deemed timely.

Because the trial judge did not sign the order sustaining the contest to appellant's affidavit within ten days of the date the appeal from the associate judge's ruling was filed and did not sign an order extending the time for conducting a hearing and signing the order, we GRANT appellant's motion to review. See TEX. R. APP. P. 20.1(i)(2), (4). The trial court's order sustaining the contest is REVERSED, and appellant is allowed to proceed in this appeal without prepayment of costs. See id. 20.1(i)(4).

As the clerk's record has been filed, we ORDER court reporter Sheretta L. Martin to file the reporter's record no later than March 11, 2016.
