In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Westchester County, dated February 10, 1960, denying his motion for summary judgment striking out the answer (Rules Civ. Prac., rule 113). Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Beldock, Christ and Brennan, JJ., concur.
