De Brito v. San Diego Packing Co.

Supreme Court of California
Sep 10, 1932
125 Cal.App. 61 (Cal. 1932)

Opinion

          In Bank.

          Hearing denied.

For former opinion, see 13 P.2d 798.           Appeals from Superior Court, San Diego County; L. N. Turrentine, judge.

William H. Wylie and H. P. L. Beck, both of San Diego, for appellants.

James G. Pfanstiel, of San Diego, for respondent.

          PER CURIAM.

          Hearing denied.

         [14 P.2d 306] PRESTON, J.

I concur in the denial of the foregoing petition because on the merits the judgment should be affirmed.           I disapprove the holding of the majority opinion of the District Court of Appeal that the specifications of error are insufficient. Moreover, the attorney for respondent specifically approved them, and this too should foreclose the opposite position.
