In re Kermit Dawson, et al. applying for writ of certiorari, First Circuit Court of Appeal. Parish of Tangipahoa.


Writ granted in part, denied in part. Assessment of costs against plaintiffs was an abuse of discretion; all costs are ordered assessed against defendant. In all other respects the writ is denied.

SUMMERS, C. J., dissents, but would grant and bring the entire case up and placed on the docket for a hearing to consider all issues.
