In accordance with the Alabama Supreme Court's opinion, see Ex parte Davis, [Ms. 1080515, September 4, 2009] 38 So.3d 706 (Ala. 2009), we reverse the trial court's judgment and remand this case to the trial court for proceedings that are consistent with that opinion.

REVERSED AND REMANDED.
