Davis v. State

Supreme Court of Florida
Dec 4, 2008
998 So. 2d 1144 (Fla. 2008)

Opinion

No. SC08-1907.

December 4, 2008.

Lower Tribunal No(s). 2D07-4846.

Petitioner's "Motion for Extension of Time to File All Writs" is hereby denied as moot.

Petitioner has submitted a "Petition for All Writs" which this Court has treated as a petition for writ of mandamus. Because petitioner has failed to show a clear legal right to the relief requested, he is not entitled to mandamus relief. Accordingly, the petition hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000).

WELLS, ANSTEAD, PARIENTE, LEWIS, and POLSTON, JJ., concur.
