IN RE DAVIS. Andre Davis, Plaintiff-Appellant, v. Kalamazoo Circuit Court Judge, Defendant-Appellee.


Order

On order of the Chief Justice, the motion of plaintiff-appellant to waive fees is DENIED because MCL 600.2963 requires a prisoner pursuing a civil action to pay a partial fee of either 50% of the average monthly deposits or the average monthly balance for the past 12 months, whichever is greater. Within 28 days of the date of this order, the plaintiff-appellant must file another motion to waive fees with the Court, along with a current certificate of prisoner account activity showing the average monthly deposits and balances for the past 12 months. Failure to timely file the motion and certificate will result in the administrative dismissal of the application.
