MEMORANDUM OPINION


Appellant did not file its brief by the deadline of October 8, 2004. On October 18, 2004, the Court sent a letter to appellant directing it to file its brief and a motion for extension of time within ten days of the date of the letter. The letter warned appellant that the appeal would be dismissed if appellant failed to comply. To date, appellant has not filed a brief. Accordingly, the Court DISMISSES this appeal. Tex.R.App.P. 42.3.
