This case is calendared for trial at the Kansas City, Missouri Trial Session of the Court scheduled to commence on October 2, 2023.

On June 9, 2023, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution. On June 15, 2023, the Court issued an Order to Show Cause requiring that petitioner file a response to the motion. On August 23, 2023, the Court issued an Order setting respondent's Motion to Dismiss for Lack of Prosecution for hearing at calendar call on October 2, 2023, in Kansas City, Missouri. On September 6, 2023, the parties filed with the Court a Proposed Stipulated Decision.

Upon due consideration, and for cause, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed with the Court on June 9, 2023, is denied as moot. It is further

ORDERED that the Court's Order to Show Cause, issued on June 15, 2023, is hereby discharged as moot.
