Appeal by petitioner pursuant to N.C.G.S. § 7A-30(2) from the decision of a divided panel of the Court of Appeals, ___ N.C. App. ___, 505 S.E.2d 581 (1998), affirming the judgment entered by LaBarre, J., on 4 September 1997, in Superior Court, Wake County. Heard in the Supreme Court 11 February 1999.
