CONDITIONAL ORDER OF DISMISSAL


By letter dated January 9, 2003, the attorney for the plaintiff advised the Court that the parties have settled this case.

IT IS HEREBY ORDERED that this case is dismissed with prejudice provided, however, that if either party hereto shall certify to this Court, within ninety (90) days, with proof of service of a copy on opposing counsel, that the agreed conditions for said settlement have not been fully performed, the foregoing Order shall stand vacated and this cause shall forthwith be restored to the calendar to be set for trial.

IT IS SO ORDERED.
