Dannenberg v. State

District Court of Appeal of Florida, Fifth District
May 25, 2007
956 So. 2d 559 (Fla. Dist. Ct. App. 2007)

Opinion

No. 5D07-676.

May 25, 2007.

3.800 Appeal from the Circuit Court for Lake County, Mark J. Hill, Judge.

Charles Dannenberg, Lowell, pro se.

Bill McCollum, Attorney General, Tallahassee, and Carmen F. Corrente, Assistant Attorney General, Daytona Beach, for Appellee.

We affirm the trial court's denial of Dannenburg's motion for jail time credit because the motion was facially insufficient. However, we caution the trial court that it is the responsibility of the court, not the Lake County jail, to calculate jail time credit.

AFFIRMED.

GRIFFIN, TORPY and EVANDER, JJ., concur.
