MEMORANDUM OPINION
The Court has before it the parties' October 26, 2009 joint motion to dismiss the appeal. The parties state they no longer wish to pursue their respective appeals. Appellee also states he wishes to dismiss his motion for sanctions. We grant the motion and dismiss the appeal and the cross-appeal. See Tex. R. App. P. 42.1(a).
