An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about March 24, 2022, and the appeal having been perfected, And plaintiff-respondent having moved to dismiss the appeal pursuant to CPLR 5701 and 22 NYCRR 12504, on the ground the March 24, 2022 order denied a motion to reargue and is not appealable as of right, and defendants' motion for permission to appeal was denied by order of this Court entered on June 23, 2022 (M-2022-01726), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted, and the appeal is dismissed. The Clerk of the Court is directed to strike the perfected appeal from this Court's calendar.
