Judgment and order reversed, on the law, and a new trial granted, with costs to the appellant to abide the event, on the authority of section 210 of the Civil Practice Act. ( Thompson v. Whitmarsh, 100 N.Y. 35; Tilyou v. Reynolds, 108 id. 558, 566.) Van Kirk, P.J., Hinman, Whitmyer, Hill and Hasbrouck, JJ., concur.
