Dear Judge Kaplan:

I am the attorney for plaintiffs in the above-referenced matter. On September 12, 2003 the parties appeared before the Court for an initial scheduling conference. At the conference it was agreed that the action should be stayed pending the outcome of the underlying criminal case which formed some of the claims for this § 1983 action. On September 25, 2003, the Court issued an Order staying the case pending further order of the Court.

I write to inform the Court that the criminal case recently ended with an acquittal of all charges for both plaintiffs. I respectfully request a scheduling conference so that the parties may begin the litigation in this matter.
