ORDER


In a July 22, 2004 memorandum in support of habeas corpus, petitioner has included motions for appointment of counsel, for preliminary hearing, and for jury trial. Petitioner is not entitled to any such relief in this case, and his motions are denied.

After making an independent review of the pleadings, files, and records in this case, the findings and recommendation of the magistrate judge, and petitioner's August 13, 2004 objections, the court concludes that the findings and conclusions are correct and are therefore adopted.

SO ORDERED.
