Cruz v. Coughlin

District Court of Appeal of Florida, Fifth District
Oct 26, 2007
967 So. 2d 1001 (Fla. Dist. Ct. App. 2007)

Opinion

No. 5D06-4013.

October 26, 2007.

Appeal from the Circuit Court for Orange County, Reginald K. Whitehead, Judge.

Sylvia A. Grunor of Weiss, Grunor Weiss, P.A., Maitland, and Amy M. Romaine of A.M. Romaine P.A., for Appellant.

David O. Doyle, Jr., and Grant A. Kuvin of GrayRobinson, P.A. Orlando, for Appellee John Coughlin.

No appearance for Appellee Carmen Rodriguez.

The trial court granted summary judgment in favor of the defendant landlord on the issue of his knowledge of a supposedly vicious dog's presence on the premises. Since the landlord established that there are no disputed issues of material fact and that he is entitled to judgment as a matter of law, the trial court was correct in granting the landlord's motion for summary judgment.

AFFIRMED.

PLEUS and LAWSON, JJ., concur.
