CRIMSON EXPLORATION, INC. ET AL., Appellants, v. MAGNUM PRODUCING L.P., Appellee.

On appeal from the 206th District Court of Hidalgo County, Texas.

ORDER ABATING APPEAL

Before Justices Rodriguez, Garza, and Longoria
OrderPer Curiam

Crimson Exploration, Inc.; Crimson Exploration Operating, Inc., successor by merger to Southern G. Holdings, LLC; EXCO Resources, Inc.; Anadarko Petroleum Corporation; Anadarko E&P Company, LP; Kerr-McGee Oil & Gas Onshore, LP; Westport Oil & Gas Company, LP; and Aubris Resources, LP f/k/a United Resources, LP, appealed from a final summary judgment rendered against them in favor of Magnum Producing L.P. ("Magnum"), and Magnum filed a cross-appeal regarding that same final summary judgment.

This is an appeal from a final judgment signed November 24, 2014. Despite the length of time that has passed since it was filed, this appeal is not yet ripe for consideration. The appellate record has been filed in multiple parts over months of time. In this regard, the reporter's record was filed on April 23, 2015. The initial volumes of the clerk's record were filed on April 2, 2015, and supplemental clerk's records were filed on May 4, 2015, July 6, 2015, December 30, 2015, and January 8, 2016.

The parties filed their respective principal briefs (as appellants and cross-appellant) on August 21, 2015 and August 24, 2015, respectively. The parties recently filed their respective briefs as appellee and cross-appellees on January 15, 2015. The parties thereafter jointly requested an extension of time to file their reply briefs on grounds that they needed additional time to "comprehensively and adequately analyze and respond to the arguments in their principal briefs and summarize the voluminous record regarding these arguments." This Court granted the parties an extension of time to file their reply briefs in order for the case to be properly presented on appeal.

Under these circumstances and in order to effectuate the proper and complete presentation of this appeal to the Court, we ABATE this appeal and remove it from the Court's active docket. The appeal will be reinstated when the reply briefs have been properly and duly filed.

IT IS SO ORDERED.

PER CURIAM Delivered and filed this the 5th day of February, 2016.
