The order denying the plaintiff leave to file the second amended complaint is reversed, and said complaint is deemed to have been filed. The judgment for the defendants is affirmed as to Counts I, II and IV, and reversed as to Count III of the second amended complaint. The case is to stand for further proceedings in the Superior Court on Count III.
