On February 7, 2024, docket entry 20, respondent filed a Motion to Dismiss for Lack of Prosecution as to Petitioner David A. Crane, Deceased (Motion). Respondent's Motion requests that this case be dismissed for lack of prosecution and that the Court find in its order that there is due from petitioner David A. Crane, deceased, a deficiency in income tax for tax year 2019 in the amount of $600.

On April 24, 2024, docket entry 26, the Court prematurely issued an Order of Dismissal and Decision. The Court will vacate and set aside this Order of Dismissal and Decision.

After due consideration, it is

ORDERED that the Court's Order of Dismissal and Decision, issued April 24, 2024, docket entry 26, is hereby vacated and set aside.
