This order modifies the Court's order of January 31, 2024. The clerk's record filed November 7, 2023 included the trial court's judgment, which stated the jury assessed punishment, but the clerk's record did not include a jury charge and verdict for the punishment stage or the trial court's certification of defendant's right of appeal. The order of January 31, 2024 required the district clerk to file a supplemental clerk's record containing the punishment charge and verdict and the trial court's certification of defendant's right of appeal. After that order issued, the reporter's record was filed, which shows the trial court assessed appellant's punishment.

Accordingly, we MODIFY the order of January 31, 2024 and vacate the requirement that the district clerk file the punishment charge and verdict. This Court's order that the district clerk file the trial court's certification of defendant's right of appeal remains in effect, and the supplemental clerk's record containing the trial court's certification of defendant's right of appeal is due FEBRUARY 15, 2024.

We DIRECT the Clerk to send copies of this order to Felicia Pitre, Dallas County District Clerk; and counsel for all parties.
