MEMORANDUM OPINION


The Court's records in this appeal reveal that appellant has not paid the required filing fee of $125 or filed a docketing statement. See Tex.R.App.P. 5, 32.1. In letters dated August 26, 2004, appellant was informed that failure to remit the filing fee and a docketing statement within ten days would result in dismissal of this appeal. Appellant has not remitted the filing fee nor filed a docketing statement.

On the Court's own motion, this appeal is DISMISSED for want of prosecution. See Tex.R.App.P. 42.3(b),(c).
