C.R. v. State

District Court of Appeal of Florida, Third District
Mar 26, 2008
978 So. 2d 835 (Fla. Dist. Ct. App. 2008)

Opinion

No. 3D06-3055.

March 26, 2008.

An Appeal from the Circuit Court for Monroe County, Sandra Taylor, Judge.

Benedict P. Kuehne, P.A., and Benedict P. Kuehne, and Susan Dmitrovsky, Miami; Coffey Burlington, LLP, and Kendall Coffey, Miami, for appellant.

Bill McCollum, Attorney General, and Timothy R.M. Thomas, Assistant Attorney General, for appellee.

Before COPE, GREEN, and WELLS, JJ.

This is an appeal from a juvenile adjudication and disposition placing C.R. in a high risk residential program. Because the court, and the Florida Department of Juvenile Justice Pre-Disposition Report upon which the court relied, failed to make specific findings as to the reasons for adjudicating and committing C.R. to the Department of Juvenile Justice, we reverse and remand for a new hearing. See Y.J. v. State, 874 So.2d 688, 689 (Fla. 4th DCA 2004) ("[F]ailure to make specific findings before adjudication and commitment of a juvenile is reversible error."). See also § 985.23, Fla. Stat. (2005).

Reversed and remanded.
