ORDER DISMISSING APPEAL

This appeal was docketed on April 2, 2012. On that same date, this court issued a notice to appellant to pay the filing fee. On April 12, 2012, appellant filed a motion to proceed in this appeal in forma pauperis. On September 4, 2012, this court issued an order denying the motion without prejudice and directing appellant to seek in forma pauperis status in the district court, pursuant to NRAP 24(a). On September 14, 2012, appellant filed a motion seeking clarification. In that motion, appellant informs this court that he has no case on appeal in this court from the Sixth Judicial District Court. This court construes the motion as a request to voluntarily dismiss the appeal. Having reviewed the motion, appellant's request to voluntarily dismiss the appeal is granted and the appeal is dismissed.

It is so ORDERED.

This court notes that appellant's failure to pay the supreme court filing fee could constitute an independent basis on which to dismiss this appeal.
