MELISSA COWINS, Appellant v. TIC ENERGY & CHEMICAL, INC., Appellee

On Appeal from the County Civil Court at Law No. 3 Harris County, Texas
Trial Court Case No. 1064293

MEMORANDUM OPINION

Appellant's brief was originally due on January 6, 2020. One extension was granted until February 5, 2020. Appellant was notified on March 16, 2020 and April 22, 2020 that the brief was late and that the appeal might be dismissed if the brief were not filed. Appellant neither timely filed a brief nor requested an extension. See TEX. R. APP. P. 38.8(a)(1) (the appellate court may dismiss for want of prosecution for failure to file appellant's brief). On April 22, 2020, appellee filed a motion to dismiss the appeal for want of prosecution.

Accordingly, we grant appellee's motion and dismiss the appeal for want of prosecution. See TEX. R. APP. P. 38.8(a)(1), 42.3(b), 43.2(f). We dismiss all pending motions as moot.

PER CURIAM Panel consists of Justices Keyes, Goodman, and Hightower.
