DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County (IDV Part), dated June 16, 2021. Motion by the appellant pro se for leave to prosecute the appeal as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal is dismissed as academic as the order dated June 16, 2021, was vacated by an order of the Supreme Court, Kings County dated October 12, 2021; and it is further, ORDERED that the appellant's motion is denied as academic.
