This case is calendared for trial at a special session in Seattle, Washington, beginning May 30, 2023. On December 15, 2022, respondent filed a Request for Admissions. On January 13 and 19, respectively, petitioner filed a Response and an Amended Response to that request. On January 25, 2023, respondent filed a Motion and an Amended Motion to Review the Sufficiency of Answers or Objections to his Request for Admissions. By Order served January 27, 2023, we directed petitioner to file a Response to the Motion in which he was to demonstrate that he is diligently working with respondent toward the finalization of a stipulation of facts. On February 22, 2023, petitioner filed a Response to the amended Motion in which he represented that he is actively and in good faith participating in the stipulation process.
On the basis of petitioner's Response, it appears that the parties may be able to resolve the discovery matters addressed in respondent's amended Motion. We will therefore deny the Motion at this time without prejudice. If the parties are unable to resolve the matters in question, respondent may file an appropriate motion or request that the Court convene a teleconference with the parties.
Upon due consideration, it is
ORDERED that respondent's amended Motion to Review the Sufficiency of Answers or Objections to his Request for Admissions, filed January 25, 2023, is denied at this time without prejudice.
