The application for leave to appeal the January 12, 2010 judgment of the Court of Appeals is considered, and it is denied, there being no majority in favor of granting leave to appeal or taking other action.
KELLY, C.J., and CAVANAGH and HATHAWAY, JJ., would vacate the judgment of the Court of Appeals and remand this case to the Court of Appeals for reconsideration in light of Lansing Sen Ed Ass'n v. Lansing Bd of Ed, 487 Mich. 349 (2010).
