IT IS HEREBY STIPULATED by and between the parties to this action pursuant Rule 41(a)(1) of the Federal Rules of Civil Procedure, that the above-captioned action I hereby is dismissed with prejudice, with each side to bear its own costs and attorneys f The parties hereto having entered into a confidential settlement-agreement, they further expressly agree to the Court's continuing jurisdiction over the matter for the purpose of; motion to compel arbitration under the terms of the confidential settlement agreement, the purpose of enforcing any arbitration decision issued in connection with any such arbitration
ORDER
It is hereby ordered that Case Number C 02-2471 EDL pending in the United States District Court for the Northern District of California is dismissed with prejudice, the parties to bear their own costs and attorneys fees. The Court hereby expressly reserves jurisdiction over the matter for the purpose of any motion to compel arbitration under the terms of the confidential settlement agreement entered into between the parties hereto, and for the purpose of enforcing any arbitration decision that may be issued in connection with any such arbitration.
