It is ordered that the opinion filed herein on May 26, 2011, be modified as follows:

1. On page 4, line 6 of the Discussion, delete the words “cannot rely” and replace with “may potentially be barred from relying.”

2. On page 4, lines 19-20 of the Discussion, delete the words “and defendants are barred” and replace with “or whether CAL-OSHA bars defendants.”

There is no change in the judgment.

Defendants’ petition for rehearing is denied.
