One appealing the Court of Common Pleas decision has thirty (30) days in which to file an appeal pursuant to 10 Del. C. § 1326. See also Cubbage v. Carroll, (Del. Super. Feb. 17, 2006).

Therefore, pursuant to the above and our telephone conference today, the Motion to Dismiss for an untimely appeal is denied.
