Opinion

March 19, 1962

In an action to foreclose a land tax lien, in which a sale of the land was held by a Referee on June 20, 1957, pursuant to a judgment of foreclosure and sale entered April 11, 1957, the Regent Boat Corp., the assignee of the purchaser (Ben Stambler) at such sale, appeals from an order of the Supreme Court, Kings County, dated April 27, 1961, which denied its motion to direct the Referee to complete the sale and to deliver to it a deed of title to the land, and which granted the cross motion of the defendant Gottesman, the former owner of the land, to declare the sale or bid void and to direct a resale de novo. Order affirmed, with $25 costs and disbursements payable by appellant to each respondent (plaintiff Cornman and defendant Gottesman). No opinion. Beldock, P.J., Kleinfeld, Brennan, Hill and Rabin, JJ., concur.
