For the reasons set forth in the accompanying Memorandum and Opinion, the plaintiffs' motion for summary judgment, (Docket Entry No. 43), is denied. The defendant's motion for summary judgment, (Docket Entry No. 46), is granted. This case is dismissed, with prejudice.
