ORDER MODIFYING OPINION

CHANEY, J.

It is ordered that the dissenting opinion filed herein December 16, 2010, is modified as follows:

1. On page 3, beginning at the fourth line from the bottom, the following is deleted: Beverly Hilton and Weiner,

The sentence now reads: The majority distinguishes these cases on the ground that in them, unlike here, the petitioners appealed Board orders.

2. On the second line of the next-to-last paragraph on page 4, the word “worker” replaces the word “workman” so the sentence reads: I agree the policy of the workers’ compensation statutes and their constitutional foundation is one of solicitude for the worker.

There is no change in the judgment.
