DECISION AND ORDER ON MOTION

Motion by Town of Ulysses and other municipalities, Association of Towns of the State of New York, New York Conference of Mayors and New York Planning Federation for permission to file a brief amicus curiae upon the appeal.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, without costs, and Town of Ulysses and other municipalities, Association of Towns of of the State of New York, New York Conference of Mayors and New York Planning Federation shall file and serve an amicus curiae brief on or before December 10, 2012.
