Before the Court is appellant's May 17, 2023 motion for an order regarding the clerk's record. By order entered May 4, 2023, the Court identified seven recordings filed with the December 15, 2021 first supplemental clerk's record as being the recordings appellant filed on a DVD on April 21, 2021. The Court further described the recordings as having been filed as Exhibits 52-58 to appellant's pretrial application for writ of habeas corpus.
In his current motion, appellant seeks acknowledgment from the Court that appellant incorporated these recordings into his First Supplement to Motion to Suppress Evidence filed on May 26, 2021. Appellant further requests supplementation of the record with Exhibits 52-58 in connection with his First Supplement to Motion to Suppress.
The record speaks for itself. Exhibits 52-58 are part of the clerk's record and before the Court. To the extent appellant has incorporated by reference Exhibits 52-58 into other motions, those recordings will be considered in connection with issues appellant raises that reference those other motions and Exhibits 52-58.
Because appellant has not shown a need for additional relief, appellant's motion is DENIED.
In accordance with our orders of May 4, 2023 and May 10, 2023, we ORDER appellant to file his brief by June 5, 2023. In view of the extensions granted, the Court is unlikely to grant any further extensions on appellant's brief.
