Opinion

APPEAL No. 1702.

October 21, 1974.

Motion of defendant to remand is granted, and the papers in this case are remanded to the Superior Court for the sole purpose of hearing and determining defendant's motion for a new trial, which is based upon his allegation of newly discovered evidence. If the motion for new trial is denied, the papers are to be returned forthwith. Motion of plaintiff to dismiss defendant's appeal is denied. Motion of defendant to strike certain papers from the record is denied.
