ORDER TO SHOW CAUSE

This case was called from the calendar of the Court's April 24, 2023, trial session for New York City, New York. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. On April 3, 2023, respondent filed with the Court a Motion to Dismiss for Failure to Properly Prosecute. On April 25, 2023, the case was recalled from the calendar and there was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. Upon due consideration, and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute is taken under advisement. It is further

ORDERED that, on or before May 25, 2023, petitioner shall show cause in writing why respondent's Motion to Dismiss for Failure to Properly Prosecute should not be granted, and a decision entered in this case. Failure to respond to this order will likely result in the granting of respondent's motion and entry of decision against petitioner. It is further

ORDERED that the undersigned retains jurisdiction of this case.
