I would remand to the Court of Appeals as on leave granted. This appears to be a prelude to a damage action against the township. The Court of Appeals would then possibly have the benefit of this Court's decision in Paragon Properties Co v Novi, 452 Mich. 568 (1996). A lot of sand and money is involved.
