JEFFREY CONSTANTINE, M.D., PLAINTIFF-RESPONDENT-APPELLANT, v. STELLA MARIS INSURANCE COMPANY, LTD., CATHOLIC HEALTH EAST, CATHOLIC HEALTH SYSTEM DOING BUSINESS AS SISTERS OF CHARITY HOSPITAL, MARY SERIO AND NICHOLAS SERIO, AS PARENTS AND NATURAL GUARDIANS OF NICOLE SERIO, AN INFANT, DEFENDANTS-APPELLANTS-RESPONDENTS.

Appellants Stella Maris Insurance Company, Ltd. having moved and appellants Catholic Health East and Catholic Health System doing business as Sisters of Charity Hospital having cross-moved for an extension of time to perfect their appeals taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on January 10, 2014,

Now, upon reading and filing the affirmation of Amanda L. Lowe, Esq., dated September 19, 2014, the affirmation of Joseph E. Zdarsky, Esq., dated September 23, 2014, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that appellant Stella Maris Insurance Company, Ltd.'s motion is granted and Stella Maris Insurance Company, Ltd. shall perfect their appeal on or before November 14, 2014, and, in the event of failure to so perfect, Stella Maris Insurance Company, Ltd.'s appeal is hereby dismissed without further order, and

It is further ORDERED that appellants Catholic Health East and Catholic Health System doing business as Sisters of Charity Hospital's cross motion is granted and Catholic Health East and Catholic Health System doing business as Sisters of Charity Hospital shall perfect their appeal on or before December 19, 2014, and, in the event of failure to so perfect, Catholic Health East and Catholic Health System doing business as Sisters of Charity Hospital's appeal is hereby dismissed without further order.
