Opinion

05 Civ. 1143 (DFE).

June 2, 2005

MEMORANDUM AND ORDER

1. On May 18, 2005, the attorneys filed a Joint Scheduling Report. Its last page said: "The parties unanimously consent to proceed before a Magistrate Judge. The case has been assigned to Magistrate Judge Douglas F. Eaton." Judge Howell held a conference on May 20, and on May 25 he signed an order referring this case to me for all purposes. I note that any appeal from a judgment entered by me would be to the Court of Appeals for the Second Circuit. I also note that the attorneys should take care not to put Judge Howell's initials after the docket number.

2. I enclose a copy of my Standing Order for Discovery Disputes. I direct the attorneys to advise my chambers of a date when they will place a conference call to me, preferably at 5:00 p.m., and preferably before June 15, 2005.
