Indictments charging defendant with burglary, attempted theft by unlawful taking or disposition, theft by receiving stolen property, theft by unlawful taking or disposition, simple assault and criminal conspiracy. Before CAIN, Jr., J., without a jury. Demurrer sustained to charge of simple assault and finding of guilty of burglary and criminal conspiracy and judgment of sentence entered. Defendant appealed. Appeal, No. 1979, Oct. T., 1976, from Court of Common Pleas, Trial Division, of Philadelphia, Feb. T., 1976, Nos. 454, 455, 457, and 458. Submitted December 6, 1976.
